In a recent and remarkable legal case, an Asian American couple from Flushing, New York, identified as Y.Z. and A.P., reached a settlement with Cha Fertility Clinic in Southern California. This case stems from a critical error that occurred during their in vitro fertilization (IVF) treatment in 2018.

Background of the Case

The couple embarked on their journey to parenthood with high hopes, investing $100,000 in IVF services at Cha Fertility Clinic. However, a grave mistake occurred during the process. Instead of being implanted with their own embryos, A.P. received embryos from different families. The error only came to light after the birth of two white boys in March 2019, a stark contrast to the twin girls the couple was expecting.

The Discovery and Legal Battle

When ultrasounds revealed the discrepancy, the clinic’s doctors initially dismissed the couple’s concerns. The reality hit home with the birth of the twins, forcing Y.Z. and A.P. to relinquish the newborns to their biological parents, which included the Manukyan family.

Following this traumatic experience, Y.Z. and A.P. initiated legal action in July 2019, accusing Cha Fertility Clinic of medical malpractice, negligence, and other counts. The legal proceedings also included a separate settlement in October 2023 with Dr. Joshua Berger, a physician at the clinic, amounting to $200,000.

The Emotional Toll and Resolution

This mix-up not only impacted Y.Z. and A.P. but also affected the Manukyans and other families involved. The Manukyans, who received one of the twins, experienced a range of emotions during the resolution of this case, highlighting the profound emotional impact on all parties.

Eventually, the case concluded with the couple settling for an undisclosed sum with the clinic, now known as Tree of Life Fertility Clinic. Despite the settlement, the emotional scars and the journey they endured remain a sensitive topic for Y.Z. and A.P.
